1. Acceptance of Terms

By applying to join #notyourdata or using our platform badge, you agree to these terms and commit to upholding the #notyourdata manifest.

If you don't agree, don't apply. It's that simple.

2. Membership Requirements

2.1 Eligibility

To become a #notyourdata member, your app or service must:

• Collect NO personal identifiers (emails, phone numbers, addresses, names) unless absolutely necessary for core functionality
• Not track user behavior for advertising or profiling purposes
• Not sell, rent, or share user data with third parties
• Implement privacy by design, not as an afterthought
• Be transparent about data practices with a public, accessible privacy policy
• Monetize ethically through subscriptions, features, or services - never through data exploitation

2.2 Verification

We manually review every application. We check:

• Your privacy policy
• Your app's actual behavior (if possible)
• Your business model
• Your commitment to user sovereignty

We reject applications that don't meet our standards. No exceptions.

2.3 Ongoing Compliance

Membership isn't permanent. If you:

• Start collecting user data
• Implement tracking or profiling
• Sell user data to third parties
• Violate the manifest in any way

You're out. Immediately. No refunds, no appeals, no second chances.

3. Use of the #notyourdata Badge

3.1 Grant of License

Approved members receive a non-exclusive, non-transferable license to display the #notyourdata badge on their website, app, and marketing materials.

3.2 Badge Requirements

When displaying the badge, you must:

• Link back to notyourdata.info
• Use the badge as provided (no modifications)
• Not imply endorsement beyond privacy practices
• Remove the badge immediately if membership is revoked

3.3 Revocation

We reserve the right to revoke badge usage at any time if you violate these terms or the manifest.

4. Member Directory

By joining, you consent to being listed in our public member directory with:

• Your app/service name
• A brief description
• Your category/sector
• A link to your website/app

You can request removal from the directory at any time by emailing info@notyourdata.info

5. Intellectual Property

The #notyourdata name, logo, and badge are our intellectual property. You may only use them as authorized in these terms.

Your app/service name, logo, and brand remain your property.

6. Disclaimers

6.1 No Warranties

We provide the #notyourdata platform "as is" without warranties of any kind. We verify members to the best of our ability, but we can't guarantee that every member always complies with the manifest.

6.2 Not Legal Advice

Nothing on this platform constitutes legal, financial, or professional advice. Consult appropriate professionals for your specific situation.

6.3 Independent Verification

Users should independently verify member privacy claims. The badge indicates our verification at a point in time, not ongoing monitoring.

7. Limitation of Liability

We're not liable for:

• Any damages arising from use of our platform or badge
• Actions or omissions of member apps/services
• Privacy violations by members
• Loss of business, data, or reputation

To the maximum extent permitted by law, our total liability is limited to €100.

8. User Reporting

If you discover a member violating the manifest:

• Email us at info@notyourdata.info with evidence
• We'll investigate within 7 days
• We'll take action if violation is confirmed

We take violations seriously. Help us keep the community clean.

9. Modifications

We may update these terms at any time. Changes take effect immediately upon posting. Continued membership after changes constitutes acceptance.

Major changes will be communicated to all members via email.

10. Termination

10.1 By You

You can leave anytime by:

• Removing the badge from your properties
• Emailing us to request directory removal

10.2 By Us

We can terminate membership immediately if you:

• Violate these terms
• Violate the manifest
• Damage the #notyourdata reputation
• Provide false information in your application

11. Governing Law

These terms are governed by the laws of Spain (where the founding member is based). Disputes will be resolved in Spanish courts.

We prefer to resolve issues amicably. Contact us before lawyering up.
